This Privacy Policy explains how Gentle Hands Senior Care, LLC (“Gentle Hands,” “we,” “us,” “our”) collects, uses, discloses, and safeguards personal information obtained through our public website (the “Site”).

We are a Texas-licensed non-medical home care / Personal Assistance Services (PAS) provider. This Privacy Policy applies only to information collected online through this Site.

Notice Regarding HIPAA and Medical Privacy

This Website Privacy Policy is not the same as our Notice of Privacy Practices (NPP) required under the Health Insurance Portability and Accountability Act (HIPAA) and the
Texas Medical Records Privacy Act (Texas Health & Safety Code Chapter 181).

When Gentle Hands provides PAS or related home-care services, we may collect, use, and maintain Protected Health Information (PHI) as part of those services. PHI is governed by federal and state medical privacy laws — not by this website Privacy Policy.

1) Information We Collect
A. Information You Provide

  • Contact details (name, email, phone, mailing address) submitted via web forms (e.g., “Contact Us,” information requests, newsletter sign-ups).
  • job-applicant details you choose to provide (e.g., work history).
  • Any other content you voluntarily submit in free-text fields.

We do not intentionally request sensitive personal data (e.g., precise geolocation, biometric identifiers, health diagnoses) through public forms. If you choose to provide such information, we will treat it in accordance with this Policy and, where required by law, obtain your consent before processing “sensitive personal data.”

B. Information Collected Automatically

  • Device and usage data (IP address, browser/OS type, referral pages, date/time stamps, page views, clicks).
  • Cookies and similar technologies (pixels, tags, local storage) to operate the Site, measure traffic, and analyze performance.

  • We do not sell personal data and do not process it for targeted advertising.
  • We do not knowingly collect or process biometric data or children’s data through the Site.
  • If our practices change (e.g., to sell sensitive data), we will post the required Texas Data Privacy and Security Act (TDPSA) notices such as “NOTICE: We may sell your sensitive personal data.”

Processing sensitive personal data under the TDPSA requires prior consent, which we
obtain whenever applicable.

4) SMS / Text Messaging & Email Communications – Opt-In and Opt-Out Options
If you opt in to receive texts (e.g., appointment reminders, status updates, recruiting
notifications):

  • You consent to receive texts to the number you provide; standard message/data rates may apply.
  • Reply “STOP” to opt out at any time; you may still receive transactional or legally required messages.
  • Please keep your contact information accurate and ensure your device can receive texts.
  • No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. 

 

Email communications comply with the CAN-SPAM Act and Telephone Consumer Protection Act (TCPA). We honor all unsubscribe requests promptly and do not send marketing messages without express consent.

5) Disclosures of Personal Information
We do not sell your personal information. We may disclose limited information only as follows:

  • Service Providers: For hosting, analytics, security, or communications support under contracts restricting use to our instructions.
  • Legal Compliance: To meet legal obligations, respond to valid requests, or protect our users and property.
  • Business Transfers: In a merger or asset sale, your data may transfer to the acquirer with notice where required.
  • With Your Consent: When you authorize us to share it.

6) Opt-Out & Preference Management

You may opt out of receiving promotional communications at any time by using the unsubscribe link in our emails or by replying STOP to any text message.
You may also submit an opt-out or data-rights request by emailing support@gentlehandsseniorcare.com.

Requests will be processed within the period required by applicable law.

7) Security
We maintain administrative, technical, and physical safeguards such as access controls, need-to-know data access, encryption (where appropriate), logging, and staff training.
In the event of a security incident involving your personal information, we will follow our incident-response plan and provide any notices required by law, including Texas Bus. &
Com. Code § 521.053 (breach notification).
No system is 100 percent secure; use of the Internet carries inherent risk.

8) Retention
We retain personal information only as long as necessary for the purposes described in this Policy or as required by law.
Certain client and employment-related records must be kept for minimum periods under Texas Health and Human Services Commission (HHSC) rules for Personal Assistance Services and will be securely disposed of after those periods.

9) Your Privacy Rights (Texas and Other States)
Under the Texas Data Privacy and Security Act (TDPSA), Texas residents have the right to:

  • Confirm and access personal data we process about you.
  • Correct inaccuracies.
  • Delete personal data (subject to exceptions).
  • Request data portability (where applicable).
  • Opt out of processing for targeted advertising, sale of personal data, or certain profiling (not currently performed by us).

Submitting Requests: Email support@gentlehandsseniorcare.com with your name, state of residence, and the right you wish to exercise. We will verify your identity (and authorized agent status if applicable) before acting.

Timing & Appeals: We will respond within statutory timeframes. If we deny a request, you may appeal by replying to our decision email with “Appeal” in the subject line and an
explanation. You may also contact the Texas Attorney General if you believe your rights  were not honored.

Universal Opt-Out Signals: Beginning January 1, 2025, we will recognize authorized agent preference signals (e.g., Global Privacy Control) as required by the TDPSA. We do not
otherwise respond to browser “Do Not Track” signals.

Residents of California, Colorado, Connecticut, Utah, and Virginia may have similar rights, which we honor where applicable.

10) Children’s Privacy
This Site is not directed to children under 13, and we do not knowingly collect personal information from them. If such data is discovered, it will be deleted promptly in accordance with the Children’s Online Privacy Protection Act (COPPA).

11) Cookies, Analytics & Preference Signals
We use cookies and similar technologies for Site operation and analytics. You may manage cookies through your browser settings. Starting January 1, 2025, we will honor qualifying universal opt-out signals for TDPSA-covered processing (see Section 9).

12) Third-Party Sites & Social Features

Our Site may link to third-party websites or social platforms. Those sites are governed by their own privacy policies, and we are not responsible for their content or practices. Please review their policies before sharing any personal information.

13) Disclaimer
The information on this Site is provided for general informational purposes only and does not create any contractual or legal relationship between you and Gentle Hands Senior Care, LLC. While we strive for accuracy, we do not guarantee that the Site will be error-free or uninterrupted.

14) Changes to This Privacy Policy
We may update this Policy periodically. The “Last Updated” date above reflects the effective date of the latest revision. Your continued use of the Site after any update signifies

16) Annual Review of Privacy Policy
Gentle Hands Senior Care reviews this Privacy Policy at least annually and updates it as needed to reflect current laws and industry standards.
